Environmental Administrative Police in the Republic of Yemen
Abstract
This research addresses the subject of environmental administrative policing, which is a key topic in administrative governance due to its importance in the lives of individuals as well as public and private entities. The research examines related issues including its concept, legal tools and methods, competent environmental protection authorities, and administrative sanctions that authorities have the right to impose on violators, relying on jurisprudential opinions and referencing extensive legislative texts related to the environment. In conclusion, the study reached several findings, including the noticeable attention given to the environment by the Yemeni legislator, providing a comprehensive legal framework to guarantee its protection. Environmental policing represents one aspect of this legal environmental protection. To achieve its objectives, the law grants authorities powers during execution, authorizing them to impose administrative sanctions when individuals or private entities fail to comply with legal provisions.
Finally, the study offers recommendations, most notably urging the legislator to stiffen administrative sanctions against environmental violators and to exempt simple environmental violations from lengthy judicial proceedings.
