Abstract

The responsibility of the administrative judiciary over the actions of the administration in the field of the public service appears as one of the basic and irreplaceable disciplinary guarantees in the disciplinary field, given the great importance it acquires; both for the public official who guarantees his rights from the arbitrariness of the administration, and the administration itself to carry out its work in accordance with what the law has specified for it.

Especially with the management having discretion to criminalize the acts attributed to the employee, and not to limit these acts to the law, which may lead to the waste of the rights of the public employee to deviate from its real goal, which is to achieve the public interest in establishing the rule of law
