This research paper focuses on alternatives to prison, aiming to explore the effectiveness of these alternatives in addressing the misconduct of prisoners in Yemen.
The content analysis method was used to classify the alternatives and analyze the texts organizing them in order to verify the effectiveness of each alternative independently.
The research concluded that there is a weakness in the effectiveness of applying alternatives that are adopted by the Yemeni law.
The study proposes multiple methods to enhance the effectiveness in question, including the introduction of a judicial monitoring system in the investigation and trial stages, raising the highest and lowest limits of criminal fines, the implementation of mandatory community service in private nonprofit institutions, adopting probations in the criminal law, and, adding an element of judicial supervision to the measure of conditional discharge.
The adoption of the daily-fine system as a modern and appropriate alternative is also suggested.
